Contractual terms
Terms and conditions
For MAGO Lüftung’s services, projects and deliveries.
Scope, prices, dates and payment terms are set out in the quotation or order confirmation. These terms form part of the contract where agreed at its conclusion. Individual agreements and mandatory law take precedence.
1. Provider and scope
These terms cover quotations, contracts, services, works and deliveries provided by:
MAGO Lüftung
Owner: Goran Babic
Dorfstrasse 5
6242 Wauwil, Switzerland
Phone: +41 76 505 31 49
Email: info@mago-lueftung.ch
Specific terms in an individual quotation or written contract take precedence. Customer terms apply only if MAGO Lüftung expressly accepts them in writing.
2. Quotations and contract formation
Website content is for information. A contact or service enquiry alone is not a binding order. A contract is formed by accepting a quotation or reaching an order agreement. Scope changes and their effects on price and timing are agreed with the customer.
3. Individual design and scope of work
Design is based on information known at the time of enquiry. The confirmed quotation, plans, specifications and amendments determine the scope. Hidden building conditions, extra service routes, core drilling, electrical work, scaffolding, lifting equipment and official requirements are included only where expressly listed.
4. Customer responsibilities
The customer provides accurate, complete information, necessary plans and timely access to work areas. Unless otherwise agreed in writing, the customer obtains permits, owner or management consent and ensures building prerequisites are met. Delays or extra work caused by missing cooperation may be charged.
5. Prices
Prices are in Swiss francs. Mandatory taxes and unavoidable surcharges for consumer offers are disclosed as legally required. Individual projects follow the prices and payment terms in the quotation. Additional work and changes are charged as agreed or according to actual work performed.
6. Payment
Invoices are payable without deduction within the period stated in the quotation or invoice. Deposits, staged payments or advance payments may be required for larger projects. Reminder fees, late interest and necessary collection costs may be charged to the extent permitted by law.
7. Timing, delivery and installation
Dates are planned carefully and are binding only when expressly confirmed as such. Manufacturer delays, force majeure, illness, exceptional weather, official measures or unforeseen technical obstacles may require a reasonable rescheduling. MAGO informs the customer as early as possible.
Benefits and risk transfer under applicable law or the individual agreement. Where installation is included, acceptance normally follows commissioning or handover.
8. Inspection, acceptance and defects
The customer inspects work and deliveries on receipt or acceptance and reports apparent defects promptly and clearly. MAGO must have the opportunity to inspect and, where required, remedy them. Mandatory legal rights remain unaffected.
9. Warranty and manufacturer guarantees
MAGO is responsible for its own work under applicable law and the individual agreement. Equipment and components may carry additional manufacturer terms or guarantees. Improper use, missing maintenance, third-party work, normal wear or external damage may exclude claims where legally permitted.
10. Maintenance and service
The scope, frequency and price of recurring maintenance follow the relevant agreement. Reminders are an optional service and do not replace the operator’s responsibility for safe, timely checks. A specific response time for faults or emergencies applies only if expressly agreed.
11. Website and customer portal
The portal supports equipment records, reminder preferences and service requests. Preferred dates become binding only after MAGO confirms them. Keep login details confidential and report suspected unauthorised access promptly. The public shop is disabled; online orders and payments are unavailable.
12. Changes, cancellations and returns
Please notify us of changes and cancellations promptly. Costs for completed work, purchased material or contract termination follow the individual agreement and applicable law. Voluntary returns or exchanges are agreed case by case. Statutory defect rights remain unaffected.
13. Liability
MAGO is liable for direct damage caused intentionally or through gross negligence. Further liability, particularly for indirect or consequential loss, lost profit or business interruption, is excluded to the extent legally permitted. Mandatory liability, particularly for personal injury, remains unaffected.
14. Intellectual property
MAGO Lüftung’s text, images, plans, concepts, marks and other content remain protected by copyright and trademark law. Use or disclosure beyond the contractual purpose requires the rights holder’s consent.
15. Data protection
Information about personal data processing is provided in our Privacy notice.
16. Partial invalidity
If a provision is wholly or partly invalid, the remaining provisions generally continue to apply. The applicable statutory rule replaces the invalid provision.
17. Applicable law and jurisdiction
Swiss law applies, excluding conflict-of-law rules and, where permitted, the UN Convention on Contracts for the International Sale of Goods. Jurisdiction is at MAGO’s registered location. Mandatory jurisdictions, particularly for consumers, remain applicable.
18. Changes
MAGO may amend these terms for future contracts. The version in force when a contract is concluded applies.
